These Terms & Conditions govern your use of The Diamond Exchange website and the purchase of products from The Diamond Exchange ('we', 'us', 'our'). By using our website or placing an order, you agree to these Terms. Please read them carefully.

1. Introduction

The Diamond Exchange is committed to providing high-quality diamonds and gemstones. These Terms apply to all purchases and transactions made through our website or showroom. By placing an order, you agree to be bound by these Terms.

2. Ordering and Contract Formation

All orders are subject to acceptance by The Diamond Exchange. When we confirm dispatch of your order, a contract is formed. We may cancel an order before dispatch for reasons including verification failure, suspected fraud, or pricing/stock errors.

3. Prices and Payment

Prices are displayed on the website and include applicable UK VAT unless stated otherwise. Payment must be received in full before goods are dispatched. Ownership of goods passes to you once full payment is cleared.

4. Product Information and Certification

We provide accurate information for all products, including carat, cut, clarity, color, and certificates from recognized gemological laboratories (e.g., GIA, AGS, HRD, IGI). We guarantee the authenticity of all items.

5. Delivery

Delivery times and charges will be communicated before dispatch. Risk passes to you when the goods are collected by the courier or picked up from our showroom. You are responsible for inspecting goods upon receipt.

6. Returns and Withdrawal

You have the right to return any product within 14 days of receipt, for any reason, provided the product is in its original condition, with all packaging, certificates, and proof of purchase. To return an item, you must notify us within 14 days and return the item within 14 days thereafter. Refunds, including standard delivery charges, will be processed within 14 days of receiving the goods. Customers are responsible for the cost of return shipping unless otherwise agreed. Customised or personalised items are included in this policy unless otherwise stated at purchase.

7. Faulty Goods and Warranty

If goods are faulty or not as described, you are entitled to a repair, replacement, or full refund. We provide a lifetime manufacturing defect warranty, excluding damage from misuse, accident, wear and tear, or unauthorized modifications.

8. Resizing and Adjustments

We may offer one free resizing within 30 days of delivery where applicable. Some items, such as full-set eternity rings, may require a remake, with any additional materials costed to you. Resizing outside this period may incur additional charges.

9. Liability

Our liability to you is limited to what is permitted under UK law. We are not liable for indirect, consequential loss or loss of profit. We do not limit liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under law.

10. International Orders

Customers outside the UK are responsible for all import duties, taxes, and customs fees. We cannot guarantee delivery times or clearance through customs.

11. Force Majeure

We are not liable for failure or delay in performance caused by events beyond our reasonable control, including natural disasters, strikes, pandemics, or supply chain disruptions. If a force majeure event persists for more than 60 days, either party may cancel affected orders.

12. Intellectual Property

All content on our website, including images, text, and designs, remains the property of The Diamond Exchange or our licensors. You may use such content only for private, non-commercial purposes. Custom designs remain our intellectual property.

13. Promotions and Discounts

Promotional offers or discounts may have specific terms and conditions. Some offers may exclude returns or combinations with other promotions, which will be clearly stated.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of England & Wales. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of England & Wales.

15. Changes to Terms

We reserve the right to amend these Terms at any time. Changes will apply to new orders placed after the changes are posted on our website.
